Permanent Residence in Australia

Permanent Residence in Australia - Business Migration Plan

Using a business plan to gain permanent residence in Australia

Our Panel Lawyers specialize in making migration to Australia easy for our clients. While it is a complex process, we can guide you and help you prepare documents to present your best possible case to the Australian Government.

We can create a customized business migration plan for you which can qualify you for permanent residence in Australia.

Customized Business Migration Plan

Our business migration plan is a 2 step visa process. The first visa is a 4 year temporary visa. The second step is an application for permanent residence.

Anyone who fits the profile (below) can get permanent residence in Australia using a customized business migration plan.

  • Willing to own & manage a business in Australia - You do not have to establish a new business; you may buy an existing business or become a partner/shareholder in a business. You do need to select a business that matches your background to some extent. A qualification or 3 to 6 years experience will normally suffice. For example, if you worked as a cook or chef, you might invest in a café in Australia. We can help you match aspects of your background to a business opportunity in Australia.
  • AUD250,000 or more to invest - This money is to invest in business and to buy a home. You do not need to show the Australian Government that you have this money until it is time to apply for permanent residence. Please note that AUD250,000 is a visa benchmark; we cannot guarantee that the business you decide to acquire will fit within this budget. The business you decide upon may cost more or less than this amount.
  • Age 20 to 49 - If you are older, a higher investment is required: if you are between 50 and 55 you need more than AUD500,000 to invest; if you are over 55 you need more than AUD2,500,000 to invest.
  • Vocational English - You do not have to prove your English language skill until you apply for permanent residence, so you could plan to improve your English after you arrive in Australia. We believe that you would need at least functional English to successfully manage a business in Australia. We are happy to discuss this issue with you.
  • Another AUD50,000 available - This is to spend on investigating business options in Australia and initial setup costs
  • The plan works best if you have an Australian resident available as your silent partner

If you fit the profile, a customized business migration plan may be a good option for you. It requires careful planning and hard work to achieve, but it can be done. To succeed you will need to live in Australia for about 2 years, actively manage the business and ensure that the business employs Australian staff whose total working hours are equivalent to 3 full time positions. We can help you select a business that will meet all the required benchmarks to qualify you for permanent residence.

Historical Note: In the past, Australia offered an ‘Independent Executive visa’ that allowed anyone with AUD250,000 and a business idea to come to Australia for 4 years, then apply to transfer to Permanent Residence if their business met certain benchmarks. Unfortunately this ‘Independent Executive’ visa in no longer available.

With careful planning we can create a business migration plan for you that will simulate this old system.
